When you authorize these integrations, we collect data from those platforms, such as product listings, inventory levels, pricing, and order information, solely for the purpose of providing the Services to you. This data is governed both by this Privacy Policy and by the applicable privacy policies of each connected platform. We do not share your connected platform data with unrelated third parties. In addition, these third-party services may collect information about you and use this information in accordance with their own privacy policies and terms of service. We do not control third party policies or practices.

We automatically collect:

  • IP address, browser type, device identifiers
  • Usage data, session logs, clickstream data
  • Approximate geolocation

  • Affiliates: Versant Affiliates, to help better tailor services, products, marketing, and advertising for Versant and such Affiliates to you and to other existing and potential customers. We may disclose all categories of information across our Affiliates. In addition, business information may be disclosed for business operational purposes.

The laws of some jurisdictions, such as the European Union and the UK, require companies to tell you about the legal basis for processing your personal data. To the extent those laws apply, we may rely on the following legal bases:

  • Performance of a contract: where use of your personal data is necessary to provide you with the Services under our Terms of Service that you must agree to in order to use the Services.

In addition, many of the above rights are subject to exceptions and limitations.

Some or all LinkSyncSell Services can only be provided if we have your personal data, therefore deletion of your data will result in termination of such Services.

We may require further documentation such as a password and user ID before granting access to your personal data. 8. SENSITIVE PERSONAL INFORMATION

"Sensitive Personal Information" means Personal Information that reveals:

  • A consumer's Social Security number, driver's license number, state identification card number, or passport number;
  • A consumer's account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
  • A consumer's precise geolocation;
  • A consumer's racial or ethnic origin, religious or philosophical beliefs, or union membership;
  • The contents of a consumer's mail, email, or text messages, unless the business is the intended recipient of the communication;
  • A consumer's genetic data;
  • Biometric information processed for the purpose of uniquely identifying a consumer;
  • Personal Information collected and analyzed concerning a consumer's health; or
  • Personal Information collected and analyzed concerning a consumer's sex life or sexual orientation.

Sensitive Personal Information also includes Personal Information that is collected and analyzed concerning a consumer's characteristics when such information falls within one of the categories described above.

Collection and Use of Sensitive Personal Information

LinkSyncSell does not intentionally collect Sensitive Personal Information except where necessary to:

  • Provide and secure the Services (e.g., authentication credentials);
  • Process payments and prevent fraud;
  • Comply with applicable laws, regulations, and legal obligations;
  • Detect and prevent security incidents, fraud, or other malicious, deceptive, or illegal activity; or
  • Perform services reasonably expected by an average user of the Services.

Where Sensitive Personal Information is collected, LinkSyncSell will limit its use to those purposes that are necessary and proportionate to achieve the purposes for which it was collected, or as otherwise permitted by the CPRA and its implementing regulations.

No Use for Profiling or Secondary Purposes

LinkSyncSell does not use Sensitive Personal Information to infer characteristics about individuals or for purposes of profiling, targeted advertising, or any purpose beyond those expressly permitted under applicable law.

Disclosure of Sensitive Personal Information

LinkSyncSell does not sell or share Sensitive Personal Information. We may disclose Sensitive Personal Information to service providers and contractors solely for the limited and specified purposes described above, subject to contractual obligations that:

  • Prohibit retention, use, or disclosure outside the scope of services provided;
  • Require implementation of reasonable security measures; and
  • Ensure compliance with applicable privacy laws.

Right to Limit Use of Sensitive Personal Information

LinkSyncSell is not responsible for compliance failures arising from user actions.

10. DATA RETENTION

We retain Personal Information:

  • As long as necessary to provide Services
  • As required for legal, tax, accounting, or regulatory purposes
  • For dispute resolution and enforcement

When you close your account, we will delete or anonymize your Personal Information within 7 days, except where we are required by law or legitimate business necessity to retain it longer.

11. INTERNATIONAL TRANSFERS

LinkSyncSell is a global company and has its headquarters in Delaware. We may transfer your personal data to affiliates, service providers, and other third parties located outside of your country of residence. This is necessary to provide our Services and for the purposes outlined in this Privacy Policy. By using our Services or providing us with your personal data, you consent to this transfer. Data privacy laws vary from country to country and may not be equivalent to, or as protective as, the laws in your home country. By using our Services or providing us with your personal data, you acknowledge that data privacy laws vary from country to country.

When we transfer your Personal Information outside the EEA, UK, or Switzerland, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses approved by the European Commission, to protect your information to the same standard required within the EEA.

Data Processing Agreement

If you use LinkSyncSell to process personal data of individuals located in the EEA, UK, or Switzerland (for example, end-consumer order data from your connected selling platforms), LinkSyncSell acts as a data processor on your behalf and you act as the data controller. In this case, our Data Processing Agreement ("DPA") applies and governs how we process that data. The DPA is available at linksyncsell.com/data-processing-agreement and is incorporated into our Terms of Service. It includes details on our security measures, sub-processors, breach notification obligations, and your rights as a data controller.

12. INTERACTIONS WITH US

Communications through the Website, Services, email, or other channels may result in the collection of your name, email address, and communication content. Providing this information is optional but may limit our ability to respond. You may opt out of marketing emails at any time by following the unsubscribe instructions in those emails or by contacting us at support@linksyncsell.com.

13. AUTOMATED INFORMATION COLLECTION

The Website automatically gathers internet or electronic network activity information including domain access, browser and operating system type, IP address, visit dates and times, webpage interactions, source websites, search terms, session IDs, and visit frequency.

14. DO-NOT-TRACK SIGNALS

Some web browsers may transmit "Do Not Track" signals to websites. Currently, our Website does not alter its data collection or use practices in response to Do Not Track signals. As standards in this area continue to evolve, we will reassess and update this practice accordingly.

15. DATA PROTECTION OFFICER

While we are not currently required to appoint a Data Protection Officer, we take our GDPR obligations seriously. All privacy-related inquiries, including GDPR requests, should be directed to support@linksyncsell.com.

The Website and Services are not intended for individuals under the age of 16. LinkSyncSell does not knowingly collect Personal Information from anyone under 16.
